1. General

1.1 Donna Ockenden Property Ltd. is a limited company (registered in England with company number 12690832) whose registered address is 3 Lion Street, Chichester, PO19 1LW. 

 

2. Making a booking

2.1 Bookings may be made via St Peter’s Studio website www.stpetersstudio.com 24 hours a day or telephone on 01243 786 993 (Monday to Friday between 8am and 4pm). 

2.3 A booking is complete once you have paid in full and received confirmation from St Peter’s Studio in writing (“Booking Confirmation”). 

2.4 Hen, stag or other parties are not permitted in the property.

2.5 We recommend that with every booking an appropriate travel insurance is taken out to include all members of the travelling party.

 

3. Payment

3.1 Payment of the balance of the letting fee plus any Cautionary Deposit must be paid to St Peter’s Studio at the time of booking. 

3.2 Non-payment within 24 hours of booking may be treated as a cancellation.

3.3 St Peter’s Studio do not and shall not be responsible for sending reminders of the outstanding payment.

 

4. Changing Booking Dates

4.1 Once a booking has been accepted and confirmed by St Peter’s Studio the booking can only be changed with the written agreement of Donna Ockenden, the owner. 

4.2 Where St Peter’s Studio agree to the change in the dates of the letting an administration fee of £30.00 must be paid by you.

 

5. Cancellation

5.1 Please ensure you have travel insurance which covers domestic travel and cancellations where you cannot travel due to a confirmed case of COVID-19, or you have been told to isolate. Please inform us as soon as possible that you are no longer able to travel. We will provide evidence of your reservation in support of your claim through your travel insurance for the cost of the stay.

5.2 If you wish to cancel your booking you must notify St Peter’s Studio in writing (“Cancellation Notice”).

5.3 A booking can only be cancelled prior to the start of the letting.

5.4 In the event that a cancellation is made then a cancellation charge is payable depending on the number of days before the letting start date the Cancellation Notice is received by St Peter’s Studio. The amount payable is set out below. Bookings include a £40 booking fee which is non-refundable. If you booked through an external website, such as VRBO or Airbnb, see the booking and cancellation policies within their sites as they may vary.

5.5  If you cancel at least 30 days before check-in you will get back 100% of the amount that you have paid. If you cancel between 14 and 29 days before check-in, you will get back 50%. Otherwise, you will not get a refund.  

    1. If a replacement guest is found the Owner may at their discretion waive any cancellation changes as above.

 

6. Duration and Times of Letting

6.1 Lettings are for a maximum of four weeks and commence at 4.00pm on the first day of the letting and end by 10.00 am on the day of departure unless otherwise notified. 

6.2 The period booked cannot be exceeded unless the Owner gives written approval. You will be liable for any cost of whatever nature incurred because of an unauthorised extension. If you wish to extend your stay, please contact St Peter’s Studio team no less than 48 hours before the due departure date and time. Extensions are subject to availability. 

6.3 Late departures are not available. In order to ensure that St Peter’s Studio is kept to the highest standards of cleanliness, our housekeeping team will be arriving at the property at 10am, on the day of the check out. 

 

7. Your Obligations

You agree:

    1. not to arrive before 4pm on the day booking commences. Between 10am and 4pm is the time for our housekeeping team to clean the house and for us to undertake any maintenance work required at the house; 
    2. to vacate the property by 10am on the day of departure;
    3. to pay for any losses or damages to the property, caused by you or a member of your party (reasonable wear and tear excluded, which for the avoidance of doubt means repairs that are decorative and wear out or come adrift in the course of reasonable use) which will be determined at the owners discretion;
    4. to inspect the inventory left at the property and report any discrepancies, or damage and faults in the property to St Peter’s Studio team within 24 hours of arrival. If no discrepancies, damage or faults are reported within this period, the property and inventory will be deemed to be correct and in full working order;
    5. to take good care of the property and leave it in a clean and tidy condition at the end of the letting. Before your departure, please make sure that empty the cupboards and fridge/freezer of any unused food or drink, empty the kitchen bin of rubbish and take any rubbish / recycling outside, in the appropriate bin.  A cleaning service is not provided during the letting unless otherwise specified or agreed. Should the Owner be dissatisfied with the condition of the property upon your departure, they may refuse to take a booking from you again. 
    6. We ask quests as a courtesy to strip the beds and leave any used towels in the shower or a bathtub. 
    7. to permit the Owners or Appointed Persons reasonable access to the property;
    8. not to sell or transfer the booking to another party without the written agreement of St Peter’s Studio;
    9. not to exceed either the total number of people stipulated in the property description or the total number of people stated in the Booking Confirmation unless previously agreed in writing with the owner
    10. not to use a cot for a child over the age of 24 months;

7.10 to respect the well-being of those occupants of adjoining or nearby properties and not to cause an annoyance or become a nuisance. Complaints from adjoining or nearby occupants to St Peter’s Studio regarding your behaviour may result in the Owner requiring you to leave the property immediately without a refund of any monies paid by you.

 

8. The Cautionary Deposit

8.1 The Owner shall be entitled to deduct from the Cautionary Deposit the cost of remedying any breach of the obligations set out in clause 8 and shall be entitled to charge any additional amount where the Cautionary Deposit does not fully cover the cost of remedy.

8.2 All disputes are the responsibility of the Owner and will be dealt with and should be settled directly between you and the Owner 

8.3 Where no breach of obligations set out in clause 8 above has occurred, you will be refunded the whole amount of the Cautionary Deposit, usually within 14 days of the end of your stay.

 

9. Non-availability of Property

9.1 If for any reason beyond the Owners’ control the property is not available on the date booked, or the property becomes unsuitable for holiday letting, all rent and charges paid in advance by you will be refunded in full and the Owner may cancel the booking.

9.2 Where possible St Peter’s Studio will provide you with four weeks notice except in extraordinary circumstances

 

10. Price Changes

10.1 The Owner has made all reasonable efforts to accurately describe the property in the information published on the website.

10.2 You acknowledge that minor differences may arise between that information given and the actual property itself.

10.3 The Owner reserve the right to amend prices quoted in published information due to errors or omissions (if applicable) such changes shall be notified to you as soon as possible.

10.4 You shall be at liberty to cancel the booking if the amended price is significantly higher than the original price quoted.

 

11. Liability

11.1 Nothing in these conditions excludes or limits the liability of the Owner:

(a) for death or personal injury caused by the Owners’ negligence; or

(b) under section 2(3), Consumer Protection Act 1987; or

(c) for any matter which it would be illegal for the Owners or to exclude or attempt to exclude their liability; or

(d) for fraud or fraudulent misrepresentation.

11.2 In all cases, except for personal injury or death, our liability to you for the total of all claims arising out of the letting is limited to the cost of the booking fees less any insurance or cancellation charges.

 

12. Pets

12.1 One well behaved dog is permitted at St Peter’s Studio unless by prior negotiation and  agreement from the Owner. 

 

13. Lost Property

13.1 At the end of every stay, please ensure you check that all personal items have been packed. The Owner will store lost property items for a maximum of one month after which they will be given to charity or disposed of.

 

14. Method of Payment

14.1 Payments can be made via St Peter’s Studio website, external websites or if you booked by telephone, the Owner will send you an invoice and you will be able to pay over the phone or by BACS. You must pay the invoice by its due date to ensure your booking is secured. 

14.2 Cheques are not accepted. 

14.3 Any charges raised against Donna Ockenden Property Limited by their bank for handling dishonoured, bank transfers or any other payments will be passed on to you and you are liable to reimburse Donna Ockenden Property Limited within seven days of receipt of notification from St Peter’s Studio. All payments by debit and credit card will not attract a surcharge. A £40 booking fee is applied to all bookings.

 

15. Overseas Bookings

15.1 Overseas applicants may pay by Mastercard or Visa in Sterling. Any charges for payments from overseas will be passed on to you.

 

16. Eligibility

16.1 Donna Ockenden Property Limited reserves the right to accept or refuse bookings in their absolute discretion.

 

17. Complaints

17.1 All complaints must be notified to the Owner as soon as reasonably practicable, as the Owner representative may be required to carry out on-the-spot investigation Owners representatives and if necessary, carry out remedial action.

17.2 If the Owner were denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the letting, then this may result in a reasonable reduction of any compensation payable to you arising out of such a complaint.

 

18. Breach of Contract

18.1 If there shall be a material breach of any of these conditions by you, the Owner reserves the right to re-enter the property and terminate the letting.

18.2 If there shall be a material breach of any of these conditions by the Owner then you have the right to terminate the letting.

18.3 In the event that the Owner is unable to find someone else to occupy the property for the remainder of your stay, no refund of any sums you have paid will be returnable to you.

18.4 Termination of the letting pursuant to condition 22.1 and 22.2 does not affect that party’s other rights and remedies.

 

19. Authority to Accept

19.1 The person who completes the booking and therefore accepts the terms of these booking conditions confirms that:

(a) he or she is authorised to agree the booking conditions on behalf of all persons included on the booking, including those substituted or added at a later date;

(b) he or she is over eighteen years of age and a member of the party intending to occupy the property; and

(c) he or she agrees to take responsibility for the party occupying the property.

 

20. Data and Privacy

21.2 In making a booking we will ask for personal information such as your name, postal address, email address, telephone number and payment details. We will only use the information that we collect about you lawfully, in accordance with all applicable laws concerning the protection of personal data; including the Data Protection Act 1998 (DPA) and The General Data Protection Regulation 2016 (GDPR) together, and with other subsequent laws “Data Protection Laws”. Your information will be processed by Donna Ockenden Property Limited in accordance with our privacy policy. If you are not booking online a copy of our privacy policy will be available on request.
